Terms of Service

These Terms of Service (“Terms”) govern your use of the BeneFill website and services operated by Elevens.ai LLP. (“we,” “us,” “our”). By creating an account or using our services, you agree to these Terms.

1. Not Medical Advice

BeneFill is an educational and informational platform. Our home safety assessments, risk scores, and modification recommendations are not medical advice, diagnosis, or treatment. They are not a substitute for professional medical judgment. Always consult your physician or a qualified healthcare provider regarding medical decisions.

2. Clinician Review

Certain assessments (Lane 3 — full professional assessment) include review by a licensed occupational therapist or physical therapist. Clinician review is provided only for Lane 3 assessments and is not available for the free quiz or self-service tiers. The clinician review generates a recommendation report; it does not establish a patient-provider relationship.

3. Coverage Pre-Screen

BeneFill may provide an estimated coverage pre-screen based on the insurance information you supply. This pre-screen is not an eligibility determination, guarantee of coverage, or promise of payment. Actual coverage decisions are made by your insurance plan. BeneFill is not responsible for claim denials or coverage limitations.

4. User Responsibilities

  • You are responsible for the accuracy of all self-reported data, including health information, household details, and insurance information.
  • You agree to provide truthful and complete information when using our services.
  • You are responsible for maintaining the security of your account credentials.
  • If you are acting as a caregiver or proxy, you represent that you have appropriate authorization from the care recipient.

5. AI-Assisted Features and Data Processing

BeneFill uses artificial intelligence (AI) to help you draft narrative responses for form fields. By enabling AI features, you acknowledge and agree to the following:

  • Limited health information is processed by a third-party AI provider. When you use AI drafting, your medical conditions, medications, allergies, age, and gender may be sent to our AI provider (Anthropic) for processing. Your name, date of birth, Social Security Number, address, phone number, email, and insurance member IDs are never sent to the AI provider.
  • AI-generated content is not medical or legal advice. All text drafted by AI is a starting point for your review. You are solely responsible for reviewing, editing, and verifying the accuracy of any AI-generated content before including it on a form submission.
  • You must consent before AI features are activated. AI features are disabled by default. You will be shown a consent disclosure explaining what data is processed before any AI feature is used for the first time.
  • You may opt out at any time. You can disable AI features in your Settings and revoke your consent. All form-filling features continue to work without AI.
  • No AI data retention. AI processing occurs in real-time. Our AI provider does not store your health information after processing is complete.

6. Form Accuracy and User Responsibility

BeneFill assists with form completion but you are solely responsible for the accuracy and completeness of all information submitted on any form, whether auto-filled, AI-drafted, or manually entered.

  • Auto-filled data is populated from your profile and connected health records. You must verify that all auto-filled values are correct before submitting any form.
  • AI-drafted narratives are generated based on limited information you provide. They may contain errors, omissions, or inaccuracies. Always review and edit AI-generated text.
  • BeneFill does not guarantee that any form will be accepted, approved, or processed by any government agency, insurance company, or other recipient.
  • BeneFill is not responsible for missed deadlines, rejected applications, denied claims, or any adverse outcome resulting from information submitted on forms completed using our service.
  • Submitting false or inaccurate information on government or insurance forms may have legal consequences. You are responsible for ensuring all submitted information is truthful.

7. Intellectual Property

All content, software, algorithms, and branding on BeneFill are owned by Elevens.ai LLP. or its licensors. You retain ownership of the photos, videos, and personal data you submit. By using our service, you grant us a limited license to process your submitted content solely for the purpose of providing our services.

8. Limitation of Liability

To the maximum extent permitted by law, BeneFill and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the service. Our total liability for any claim shall not exceed the amount you paid to BeneFill in the twelve (12) months preceding the claim.

BeneFill does not guarantee the availability, accuracy, or completeness of any information provided through the platform. Home modification recommendations are provided as guidance and do not replace professional on-site evaluation.

9. Dispute Resolution

Any disputes arising from these Terms or your use of BeneFill will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in San Francisco, California, or remotely at your election. You agree to resolve disputes on an individual basis and waive any right to a class action.

Either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property or data security. These Terms are governed by the laws of the State of California.

10. Account Deletion

You may delete your account at any time through your account settings or by contacting support@benefill.ai. Upon deletion, we will remove your personal data within 30 days, except where retention is required by law or necessary to resolve pending claims or benefits filings.

11. Modifications to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on our website. Your continued use of BeneFill after changes become effective constitutes acceptance of the updated Terms.
